Committee on Appeals to the PTAB


This committee relates to appeals to the PTAB, including ex parte appeals and reexamination appeals. It proposes to the Board of Directors responses to legislative proposals, modifications to appeal rules and procedures, and comments on amicus briefs that implicate PTAB appeals.  It also collects and organizes ex parte/reexamination appeal statistics and PTAB opinions. This committee is also expected to coordinate with other committees to help with substantive communications, programs, and other needs that implicate appeals to the PTAB.

January 18, 2023- PTAB Bar Association Survey Results: A Discussion of the Ins and Outs of Ex Parte Appeals and Oral Arguments Before the PTAB
In 2021, the Appeals TO the PTAB Committee conducted a survey of the Association’s membership asking questions about after-final practice, fees, and many aspects of ex parte appeals practice, including oral argument before the PTAB.  The Appeals TO the PTAB Committee compiled the results and presented them to PTAB leadership last year.  This webinar discussed the findings and initial feedback we received from PTAB leadership regarding ex parte appeals practice.  We were pleased to have Vice Chief Justice Melissa Haapala join the discussion of the results which focused on key parts of ex parte appeals including procedures for handling new grounds of rejection, related statistics, and a discussion regarding oral argument before the Board.  Click here to access a recording of the presentation.  The PowerPoint from the presentation can be found here
